1.1 Use of the Service
To use this website, you must agree to the following terms and conditions. You will be deemed to have accepted these terms and conditions when you click the "I have read and agree to these terms and conditions" button.

This is an agreement between you and Towers Watson Hong Kong Limited ("Towers Watson") for the use of this Service and related features (the "Service").  The agreement commences with effect from the date that you press the "Submit" button.

The Service is owned and operated by Towers Watson. Your access to this Service is subject to these terms and conditions, notices, disclaimers and any other terms and conditions or other statements contained on this Service (referred to collectively as "Terms and Conditions").

1.2 Your Responsibilities
You are responsible for providing and/or procuring all e-mail addresses and all equipment, software (other than any software provided by Towers Watson) and services necessary for you to access the Service. 

You must be the only user of this Service and must not disclose any login information to any other person.

You will use reasonable means to protect equipment and software used to access the Service from any virus, bug, trojan, intrusion or any other contamination that may be conveyed by information acquired through use of the Service.

You will not use any robot, spider, other automatic device or manual process to monitor or copy the Service without the prior written permission of Towers Watson.

1.3 Personal Identification Number (PIN)
You will be required to obtain a PIN in order to use some or all aspects of this Service. 

You understand and agree that you shall be responsible for maintaining the confidentiality of your PIN. You agree that you will promptly inform the Scheme Administrator to change your PIN in the event that you become aware of any breach of the confidentiality of your PIN.

You must take reasonable care when accessing the Service to ensure that your PIN is not disclosed to any other person or is observed by any other person.

You must not disclose your PIN to any other person.

You must not authorize any other person to access this Service using your PIN.

You are entirely responsible for any and all authorized and unauthorized use of your PIN. Towers Watson accepts no responsibility for the use of your PIN by you or any other person.

1.4 Copyright
Except where necessary for viewing the information on the Service on your browser, or as permitted under the Copyright Law or other applicable laws or these Terms and Conditions, no information on this website may be reproduced, adapted, uploaded to a third party, linked to, framed, performed in public, distributed or transmitted in any form by any process without the prior, specific written consent of Towers Watson.

1.5 Terminating the Service
You may stop using the Service at any time.  Towers Watson may terminate this agreement and your use of the Service at any time in its sole discretion, and with prior notice.

Paragraphs 1.3, 1.6 and 1.7, and this paragraph 1.5 shall remain in effect even though this agreement has been terminated.

1.6 Representations and warranties about the Service
Towers Watson does not warrant that the Service will be uninterrupted, free from computer viruses, trojans, bugs, vulnerabilities or errors, and makes no representation or warranty as to the results to be obtained from use of the Service.

The Service may contain links to resources located on servers maintained by others over whom Towers Watson has no control.  Towers Watson makes no representation as to, and accepts no liability for, the accuracy or any other aspects of the information contained on such servers or with respect to any other matter relating to or arising in connection with access to such resources or servers. The Service is provided on an "As Is" and "As Available" basis, and Towers Watson expressly disclaims all conditions, warranties and representations expressed or implied by statute, common law or otherwise including, without limitation, warranties of merchantability, title, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

Use of the Service is at your own risk. Neither Towers Watson nor any of its affiliates or employees will be liable for any special, direct,  indirect, incidental, consequential, or punitive damages, or any other damages whatsoever, whether in an action of contract, statute, tort, or otherwise, relating to the use of the Service.

Nothing in these Terms and Conditions shall operate to exclude or restrict Towers Watson's liability for death or personal injury resulting from negligence, fraud, or where such exclusion or restriction would not be permitted by law. 

1.7 Indemnity
You agree to indemnify Towers Watson against all liability, loss, damage, cost and expense (including reasonable legal fees) incurred by Towers Watson arising directly from or relating to your use of the Service, the use of your PIN by another person, or any act, error or omission by you including, but not limited to, matters relating to incorrect, incomplete or misleading information given by you in connection with the Service or violation of any applicable law. 

1.8 Amendments to the Service
By posting revised versions of this agreement on the Service or otherwise providing notice to you, Towers Watson thereby modifies the terms of this agreement and may discontinue or revise any or all other aspects of the Service in its discretion and with prior notice. All such changes become effective on the posting of the revised agreement on the Service and each revised agreement governs your future use of the Service. Each posted version of this agreement supersedes any prior paper or other media-based copies of this agreement that may have been included in any software or related materials provided by Towers Watson.

1.9 No financial or investment advice
The material set out in this website is made available in good faith and has been derived by sources believed to be accurate as of the time of compilation.

(d) This agreement and the Service are governed by the laws of Hong Kong SAR and the venue for any dispute relating in any manner to the Service will be a court of competent jurisdiction in the Hong Kong SAR and you waive all defenses inconsistent with such venue.

(e) If any provision of this agreement is held to be invalid, illegal or unenforceable, it will not affect the validity, legality and enforceability of any of the remaining provisions.

(f) You may not assign this agreement without written permission from Towers Watson. 

(g) This agreement constitutes the entire agreement between you and Towers Watson with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements, understandings and discussions with respect to such subject matter.
